条約が明記すべき権利とは何か?

この文書の目的は、障害者人権条約に含める権利の種類、そしてこれらの権利を障害者の状況に適応させるためのアウトラインを設けることである。専門家会議の参加者が示した見解に基づいて書かれている。

各権利の下に、権利の構成要素の例があげられている。これらの例は完全ではなくあくまでも一例であり、会議で出された意見に基づくものである。

条約に違反もしくは条約規定を無視した、国際的・全国的なあらゆる法的規定および行政の取り決めや決定は、最初から無効とみなされる。

中心的な原則・権利

以下は条約の解釈の基準となる原則と権利である。

人間としての基本原則

・ 尊厳、自己決断、[自立]
・ 平等と差別反対 - 改善措置は差別とみなさない。差別からの保護は、障害者と関わる人々にも及ぶ。
・ 生活の全活動における完全参加
・ 生活の全段階における個人の成長と成就
・ あらゆる形の暴力からの解放
・ 障害者の多様性

政府の義務に関する基本的理解

・ 政府による、公的な行動に結びつける義務と、民間の行動を規制する政府責任に結びつける義務(民間の経済活動または市民社会全般に関わらず)

・ 累進の原則 [実施に大きな資源の割り当てを必要とする権利の累進的な実現に関する原則。逆行的な施策は、それが他の権利の擁護のためで、最も弱い立場の人々の状況を考慮すると証明できない限り、条約の明確な違反として認識される[ICESCR]。

・ 条約で重んじられる権利を広く普及させ、啓蒙する政府の義務

A:平等で有効な市民的権利

個人の擁護

1.優生学的な法律と政策の禁止

・ 障害に基づいた妊娠中絶を推進しない政府の義務
・ 障害に基づいた妊娠中絶を奨励する政策の禁止
・ 生物医学・バイオテクノロジーでの進歩(遺伝子学の進歩を含む)が障害者の権利向上に結びつけられることを保障する。
・ 生物医学、バイオテクノロジー、遺伝子学の研究の倫理基準を監視し、これらが障害者の権利を尊重ならびに促進し、差別なく実施されることを確認する。

2.拷問、非人間的、または人間の尊厳を無視した扱いからの解放(文案18節)

・ 公共もしくは民間の施設に関わらず、全ての暴力の禁止
・ 治療という名目での強制的な介入の禁止
・ 有罪で拘置所に入れられた障害者が、障害を理由として状況の悪化や権利侵害にさらされない権利
・ 全ての形の暴力の禁止(身体的、心理的、性的、経済的)

3.身体と精神の保全

・ 承諾を求められる権利、治療を拒否する権利、有害な治療からの保護、臨床実験の規制、治療へのアクセスなどの待遇問題を含む。

4.プライバシーの権利

・ プライバシー全般、並びに個人情報の扱いや施設内でのプライバシー

自由への権利(訳注:リバティー:圧政・暴力的支配からの自由)


5.自由への権利

・ 実際の障害、または障害と認識された状態を理由として強制的に拘束されない権利

6.裁判の権利

・ 必要措置の効果的な保障(通訳、法的援助)
・ 平等な条件のもとでの裁判プロセスへの参加
・ 裁判上の保障
・ 裁判プロセスにおける障害を理由とした2次被害の禁止
・ 証人となること
・ 裁判プロセスへの参加と理解を促進する方策へのアクセス
・ 法律の専門家や裁判官による障害への適切な認識
・ アクセス可能な形式の法的資料と情報(憲法、法律、その他条例などを含む)

7.法的能力の権利

・ とりわけ自分に関係する全ての事柄に関する意思決定
・ 支援を受けて意思を決定する権利
・ 特例で限られた形の法的な代理が必要な場合、本人の権利を擁護するための明確な保護手段が備えられるべきであり、さらに代理の必要性とその機能な適切な実施が司法機関により定期的に審査されるべきである。このとき、代理される人の人権が尊重されるべきであり、(訳注:以下理解できず:and advanced directives (directing who to represent one and which treatment is acceptable) be given legal status)

結社の自由

8.障害者の協会を設立する権利

・ 助言を求められるための障害者代表組織の発言権
・ 市民社会の全側面において参加する権利

9.家族の権利

・ 家族をつくること(家族の種類の多様性を認める)
・ 家族と共に生活すること
・ 障害を持つ親が養子をとる権利、並びに全ての状況において子育てへの適切な支援を受ける権利
・ 障害を持つ子どもがいる家族が、子どもを自ら育て、支援する権利
・ 障害を持つ親が差別を受けない権利

言語とコミュニケーションの権利

10.言語の権利

・ 手話、点字、及び他のコミュニケーション方法など、各障害の特徴に合わせる
・ 自然言語および公式言語の能力育成、そしてバイリンガルおよびマルチリンガルな能力育成における手話への権利(訳注:The right to sign language for natural and official language development and bi/multilingual competence)

11.コミュニケーションの権利

・ 言語を使わない人のために特別な補助を利用する権利
・ 人が自らのコミュニケーション方法を利用し、その方法を公的に認められる権利
・ 手話、点字、ブリス・シンボル等を含む、別のコミュニケーション方法を通して知識、情報、サービスなどを受ける権利

12.宗教の自由

・ 宗教生活に参加する権利を含む
・ 精神的育成(訳注:spiritual development)の機会

13.表現の自由

・ 表現を可能とする積極的な改善措置

B:平等で効果的な政治的権利

14.政治団体の結成ならびに加入の権利(草案第21節)

・ 障害者が公的・政治的な全ての事柄について正しい知識を持った選択ができるよう、情報へのアクセスを有する権利

15.政治的・公的生活に参加する権利

・ 投票および立候補する権利、並びにこれらに必要な全ての支援を受ける権利

16.市民としての義務に参加する権利

・ 陪審員任務、公的調査に参加する権利、組合など

17.平等な市民権

・ 市民としての完全参加を含む全ての恩恵

18.移住および亡命に関して差別を受けない権利


C:障害者が自由を獲得するための社会的な権利と支援

19.教育への権利(草案第13節)

・ 心理社会的な支援を含む

20.働く権利(草案第14節)

・ 募集、雇用、給料、労働条件などで差別がないこと
・ 合理的配慮供与(訳注:reasonable accommodation)の方針:職業の環境と職場の適応。心理社会的な支援を含む。

21.健康への権利(草案第10・11節)

・ 自らの身体を用いて、子を産み、家族を計画するための性的・生殖的権利
・ HIVと障害
・ 入院患者・外来患者に関わらず任意でない治療からの解放

24.社会保障への権利

・ 他のサービスの受け入れを条件としたサービス提供の禁止(サービスの個別化)
・ 重度障害者のいる家族が、介護者の一時休息(訳注:respite care)を含む障害関連費用に対し、政府からの支援金を得る権利

25.文化、レクリエーション、スポーツへの権利(草案第20節)。偏見やステレオタイプのないイメージを普及させる権利

What Rights Should the Treaty Contain?

The purpose of this paper is to set out an outline of the kinds of rights that might be included in a Human Rights and Disability Treaty and how they might be tailored to the situation of persons with disabilities. It is based on the expressed views of the participants of the experts meeting.

Under each right we try to indicate examples of the components of the rights. This listing is not exhaustive and is purely indicative and is based on the views expressed at the meeting.

Any international or national legal provision and/or administrative arrangement or decision in contravention with or derogation of the provisions of this convention shall be deemed void ab initio.

Overarching Principles/Rights.

These are principles or rights that should guide the interpretation of the convention.

Basic Human Principles

- Dignity, self-determination, [autonomy].
- Equality and Non-Discrimination - Positive Action not to be considered discriminatory. Discrimination protections to extend to those associated with persons with disabilities.
- Full participation in all life activities
- Personal development and fulfillment at all stages of life.
- Freedom from all forms of violence.
- Diversity of people with disabilities

Basic Understandings as to State Obligations.

- State Obligations to extend to public action and also to engage
State responsibility to regulate private action {whether private economic activity or civil society in general}.

- Principle of Progressivity [principle of progressive realization of rights whose implementation requires significant allocation of resources. Retrogressive measures are to be considered a prima facie violation of the convention unless the State can prove that the measures are taken for the protection of other rights and take into consideration the situation of the most vulnerable groups [ICESCR].

- State Obligation to disseminate widely and raise awareness of the rights that are consecrated in the Convention

A: Equal Effective Civil Rights.

Protecting the Person

1. Prohibition of Eugenic Laws and Policies.

- The obligation of the State not to promote abortion on the basis of disability.
- The prohibit of policies that encourage abortion on the basis of disability.
- Ensuring that biomedical and biotechnological advances {including genetic advances} are tied to the advancement of the rights of persons with disabilities.
- Monitoring the ethical basis of biomedical, biotechnological and genetic research in order to ensure that it respects and advances the rights of persons with disabilities and is conducted on a non-discriminatory basis.

2. Freedom from torture, inhuman and degrading treatment. (draft Art 18).

- Prohibiting, among other things, all violence issues whether in public or private institutions
- Prohibiting and forced intervention in the name of treatment.
- Right of the people with disabilities who are convicted and in jail to not endure further aggravation due to their disability as well as the non compliance of the rights.
- Prohibiting of all forms of violence (physical, emotional, sexual and economic)

3. Right to bodily and psychic integrity.

- Including such treatment issues as the right to consent, right to refuse treatment, protection against harmful forms of treatment, regulation of clinical trials, access to treatment.

4. Right of privacy.

- Generally, and dealing with personal records and privacy in institutional settings.

Liberty Rights

5. The right to liberty.

- The right not to be interned involuntarily on account or actual or perceived disability.

6. Right to justice.
- to effective guarantees of due process [interpretation, legal aid],
- to participate on equal terms in the judicial process,
- to have judicial guarantees,
- to prohibit the re-victimization in the judicial process on the basis of disability,
- to be a witness,
- to have access to the means that facilitate the participation and comprehension of a judicial process)
- sensitization of the legal profession and judiciary to disability.
- to all legal material and information [including Constitutions, laws and other ordinances] in an accessible format.

7. Right to a legal capacity.
- Especially with respect to decision making on all matters that concern oneself.
- The right to supported decision making.
- In exceptional cases, where limited legal representation is required, this should be bounded by clear safeguards to protect the rights of the person and to be periodically reviewed by judicial authorities to verify the need of the representation and the proper exercise of the function while appreciating the
human rights of the represented individual and advanced directives (directing who to represent one and which treatment is acceptable) be given legal status

Freedom of Association

8. The right to form associations of persons with disabilities.
- Rights of standing of representative bodies to be consulted.
- right to participation in all aspects of civil society

9. Family Rights.
- to form a family [acknowledging the diversity of family types],
- to live with a family,
- the right of parents with disabilities to adopt and in all circumstances to receive appropriate support for the raising of their children
- the right of families with children with disabilities to keep and raise their children and to support for their children
- The right for parents with disabilities not to be discriminated against.

Language and Communication Rights

10. Linguistic rights.
- According to the particular characteristics of each disability such as Sign language, Braille, and alternative communication codes)

- The right to sign language for natural and official language development and bi/multi-lingual competence

11. Right to communicate
- The right to use special assistance for those who do not use language.
- Right to use one s own form of communication and to have it officially recognized.
- The right to receive knowledge, information and services in alternative communication codes including sign language, braille, and bliss .

12. Freedom of Religion.
- Including the right to participate in religious life.
- Opportunities for spiritual development.

13. Freedom of expression.

- Positive action enabling expression.

B: Equal Effective Political Rights.

14. Right to form and join political parties. {draft Art 21}.
- right to accessible information to enable persons with disabilities to make informed choices on all public and political matters.

15. Right to take part in political and public life.

- Right to vote and stand for elections and to all support necessary.

16. Right to participate in civic responsibilities.
- For example, jury service, right to participate in public inquiries, unions

17. Equal right to citizenship

- Including all the benefits including full citizenship participation

18. The right to non-discrimination with respect to immigration and asylum.

C: Social Rights and Support to Achieve the Freedom of Persons with Disabilities.

19. Right to Education {draft Art 13).

- Including psycho-social support

20. Right to Work {dratt Art 14~.

- No discrimination in advertising, hiring, promotion, salary, terms and conditions of employment.

- Principle of reasonable accommodation - workplace and workstation adjustment. Including psycho-social support.

21. Right to Health {draft Arts 10 & 11).

- Sexual and reproductive rights to use one's own body, to procreate, and to plan a family
- HIV and disability.
- Freedom from involuntary treatment whether on an in-patient or out-patient basis.

22. Right to an adequate standard of living

- housing, food, and clothing (draft Art 19).

23. Access Rights:

- built environment,
- transportation,
- communications environment,
- the Information Society (Internet, web design, eGovernment)
- access to information and documentation,
- access to all systems of society, ATMs, announcements in public places, timetables,
- right to technical assistance, technological and phsycho-social support, to be economically accessible {draft Arts 11,7).
- Access to goods and services

24. Right to Social Security.

- no conditioning of services on acceptance of obligations with respect to other services (the unbundling of services).
- The right of the family with a member with a severe disability to receive subsidies from the State to cover the disability-related expenses, including respite care


25. Right to culture, recreation and sport {draft Art 20). Right to promote an image free of prejudice and stereotypes
