Third meeting of the Geneva-based UN agencies on the proposed new convention
on the rights and dignity of persons with disabilities

議事録

2002年9月に国連人権高等弁務官事務所（ＯＨＣＨＲ）の呼びかけにより、ジュネーブに本部を置く国連機関が非公式な会合を持ち、「障害者の権利及び尊厳の保護及び促進に関する総合的かつ包括的な国際条約」を検討するために国連総会が設けた第一回アドホックの成果について話し合った。ＯＨＣＨＲ，ＩＬＯ、ＷＨＯは、この会合を定期的に開催することで合意した。今後この会合は情報交換、条約促進に利用し、さらにジュネーブに本部を置くＮＧＯ／ＤＰＯ（障害者団体）も招き、条約に関する意見交換の場としても利用することにした。
ジュネーブに本部を置く国連機関主催の「障害者の権利と尊厳に関する条約」に関する第三回会合は2003年9月3日にパレ・デ・ナシオンに於いて開催され、ＩＬＯ、ＯＨＣＨＲ，ＷＨＯからの代表者が出席した。国連経済社会問題局（ＤＥＳＡ）の社会政策・開発部、ＦＡＯ，ＵＮＤＰ，ＵＮＥＳＣＯ，ＵＮＩＣＥＦ，世界銀行も招待したが、出席できなかった。そのほか、アムネスティー・インターナショナル、Human Rights Watch、ハンディーキャップ･インターナショナル、Landmines Survivors Network（地雷生還者ネットワーク）の代表者が参加した。

ＯＨＣＨＲのセンシ氏 (Mr. Sensi)がアドホックのこれまでの主要な動きについて報告し、特に2003年6月16〜27日ニューヨークで開かれた第二回アドホック会議に関する詳細を説明した。この会議では、2004年5月、6月頃に開催予定の第三回アドホック会議での討議のたたき台となる条約草案を起草するためのワーキング・グループの設置を決定した。

地雷生還者ネットワークのヤング氏 (Ms. Young)から、ワーキング・グループに参加するＮＧＯ代表者が決定したという報告があった。12名のＮＧＯ代表者は次のように割り当てられた：国際障害同盟（ＩＤＡ）の各団体からそれぞれ1名の代表、世界の5地域からそれぞれ1名の代表（全アメリカ、アフリカ、アラブ、アジア太平洋、ヨーロッパ）。代表者の人選は次の基準に基づいて、国際障害コーカス(International Disability Convention Caucus)が決定した：(a)人権及び障害分野における専門性、 (b) 自身の障害経験を持つ、(c)ＮＧＯ及び障害者組織との関わり。また、地域、ジェンダー、障害の種類などが公平に代表されることも考慮された。

下記の国がワーキング・グループに入ることが確定しているようである：

• GRULAC: (a) コロンビア（Colombia）; (b) エクアドル（Ecuador）; (c)ジャマイカ（Jamaica）; (d) メキシコ（Mexico）; (e) ベネズエラ（Venezuela）
• アジア: (a)中国（China）; (b)インド( India); (c) 日本(Japan); (d) 韓国（Korea）; (e) レバノン（Lebanon）; (f) フィリピン（Philippines）; (g) タイ（Thailand）
• WEOG: (a) フランス（France）; (b) アイルランド（Ireland）; (c) イタリア（Italy）; (d) オーストラリア又はカナダのいずれか; (e) イギリス（U.K）。このリ　　ストは変更される可能がある。
• アフリカ及び東ヨーロッパ：この地域の代表はまだ代表者を決定していない。

国家組織の代表は南アフリカ人権委員会のシャルロット・マクレイン氏(Ms. Charlotte Mcclain)に決定。

ヤング氏は、アドホックのワーキング・グループへのインプットのため、ＮＧＯ主催の地域会議がアイルランド、スペイン、西アジアで開催されることも報告した。

会議参加者は、第二回アドホック委員会の成果について話し合った。ワーキング・グループの構成及び委託された任務の曖昧さなどについて意見が交わされた。ワーキング・グループへの国連機関の参加方法が設置の際の決定に示されていないが、その方法に付いて会議参加者から多くの疑問があがった。

また、条約の種類に関する討議が行われた。第二回のアドホックの会議中にこの件を明確にする決議がなかったことが悔やまれた。この問題は基本的なことであり、ワーキング・グループを作る前に明確にする必要があったという意見で一致した。

この後、会議参加者は、ワーキング・グループの作業に対して、国連機関およびＮＧＯが支援する必要性について話し合った。

次回のジュネーブに本部を置く国連機関及びＮＧＯの会議は2003年11月中旬に開催される予定である。

In September 2002, the Office of the High Commissioner for Human Rights (OHCHR) convened an informal meeting of Geneva-based UN agencies to discuss the outcomes of the first session of the Ad Hoc Committee established by the General Assembly "to consider proposals for a comprehensive and integral international convention to promote and protect the rights and dignity of persons with disabilities." OHCHR, ILO and WHO agreed to hold brief informal consultations on a regular basis with a view to exchanging information and encouraging efforts on the proposed new convention, and to extend an invitation to those Geneva-based NGOs/DPOs which could be interested in contributing to discussions concerning the proposed new convention.

The third meeting of Geneva-based UN agencies on the proposed new convention on the rights and dignity of persons with disabilities took place in Palais des Nations, on 3 September 2003. ILO, OHCHR and WHO were represented at the meeting; the Division for Social Policy and Development of the UN Department of Economic and Social Affairs (DESA), FAO, UNDP, UNESCO, UNICEF and World Bank were invited but were unable to attend. Amnesty International, Human Rights Watch, Handicap International and Landmines Survivors Network also participated in the meeting.

Mr. Sensi (OHCHR) briefed the meeting on the Ad Hoc Committee established by the General Assembly to consider proposals for a new convention on disability. He summarised the main elements of the process, and focused in particular on the second session of the Ad Hoc Committee (New York, 16-27 June 2003). The Ad Hoc Committee has established a working group to draft a negotiating text for consideration by the Ad Hoc Committee at its third session, expected to take place in May/June 2004.

Ms. Young (Landmine Survivors Network) informed participants that the NGO community has selected its representatives for the working group established by the Ad Hoc Committee. The 12 seats have been distributed as follows: 1 for each member of the International Disability Alliance (IDA) and 1 for each geographical region (Americas, Africa, Arab region, Asia-Pacific and Europe). The selection was made by the steering committee of the International Disability Convention Caucus on the basis of the following criteria: (a) expertise on human rights and disability; (b) personal experience of disability, and (c) previous involvement with NGOs/DPOs. Equitable geographical representation, gender balance and diversity of disability were also taken into account.

The following countries will apparently be represented in the working group:

• GRULAC: (a) Colombia; (b) Ecuador; (c) Jamaica; (d) Mexico; (e) Venezuela.
• Asia: (a) China; (b) India; (c) Japan; (d) Korea; (e) Lebanon; (f) Philippines; (g) Thailand.
• WEOG: (a) France; (b) Ireland; (c) Italy; (d) one between Australia and Canada; (e) U.K. This list is subject to modifications.
• The African and Eastern European groups have not yet agreed on their representatives in the working group.

The representative of National Institutions will be Ms. Charlotte McClain of the South African Human Rights Commission.

Ms. Young also informed participants that the NGO community is planning to organise regional meetings (Ireland, Spain, Western Asia) with a view to contributing to the work of the Ad Hoc Committee's working group.

The meeting then discussed the outcomes of the second session of the Ad Hoc Committee. Participants exchanged views on the composition and the unclear task entrusted to the working group of the Ad Hoc Committee. In particular, the meeting had questions about the modalities for participation of UN agencies in the working group - which is not foreseen in the decision which establishes it.

The meeting also considered the issue of the type of treaty to be considered, and regretted that a decision in this regard was not taken during the second session of the Ad Hoc Committee. Participants agreed that this issue represents a preliminary question that should have been solved before the establishment of the working group.

Participants then discussed the need for both UN agencies and NGOs to consider ways to contribute to the efforts of the working group.

The next meeting of Geneva-based UN agencies and NGOs will tentatively take place in the middle of November 2003.
