新しい条約の起草指針
障害のフレームワークにおける新しい人権条約
１． 障害者権利条約には主に強制可能な権利が含められるべきであり、障害者がその人権と基本的自由を行使できるようにするための措置が取り入れられる必要がある。とりわけ、自由、自立、尊厳、自主決定、平等、社会的連帯の価値基準をもとに起草される必要があり、障害者集団にこれらの基準が平等に適応されること、そしてこれが完全参加に至ることが認識されるべきである。
２． 既存の人権基準と比べてより低い基準は受け入れてはならない。
３． 人権条約団体が障害分野において現在まで築いてきた実績を基礎として、条約は組み立てられるべきである。
既存の人権基準との一貫性の保障
４． 障害者権利条約は、６つの主要な人権条約のもとで条約モニタリング団体により行われているモニタリング活動を、補完ならびに強化するべきである。
５． 条約の執行方法の検討には、基準規則、世界行動計画、並びに他の関連文書が基準として利用されるべきである。
多様な集団や社会経済的状況への適切な認識の保障
６． 条約を起草する際は、全ての障害者集団の状況、そしてジェンダー、民族、肌色、年齢などに関連する多様な状況に配慮しなければならない。
７． 条約を起草する際は、開発途上国および転換期にある国に住む障害者へ、特別な配慮が置かれなければならない。
絶対的な必要条件としての障害者の積極参加
８． 条約の起草プロセスには、自らを代表できない重度知的障害者の親の組織を含む、障害者の代表組織を通した、障害者の最大限の参加に基づいて進めなければならない。
政府は障害者組織との広範な協議を開始するべきであり、また、国連の条約起草会議に参加する自国の代表団へ障害者組織の代表者を含めるべきである。
国連は条約の起草プロセスにおいて、国際障害同盟の所属組織などの全国的・地域的・国際的な障害者の代表組織の広範な参加を保障するべきである。
開発途上国の障害者や女性障害者の組織による参加を保障する積極的な取り組みが必要である。
強力な強制機構の設置
９． 個人と集団からの苦情への対応を含む、条約の実施状況のモニタリングと報告を目的として、国際レベル・全国レベルの双方において、関連する条約モニタリング団体を設置および強化するべきである。
１０．条約のモニタリングと実施において、障害者組織が参加できる機構が設置されるべきである。
PRINCIPLES FOR DRAFTING OF A NEW TREATY
A new Human Rights Treaty in a Disability Framework
1. A disability convention should primarily contain rights that are enforceable,
and it should incorporate measures to enable persons with disabilities
to exercise their human rights and fundamental freedoms. In particular
it should be grounded on the values of liberty, independence, dignity,
self?determination, equality, social solidarity and rccognizing that these
values apply equally to diverse groups of persons with disabilities and
shall result in full participation.
2. Standards below already existing human rights standards must not be accepted.
3. It should build on the existing positive achievements of the human rights
treaty bodies in the disability field.
Ensuring Consistency with Existing Human Rights Standards
4. A disability convention should complement and strengthen the monitoring
of disability rights by the treaty monitoring bodies under the six core
Human Right Treaties.
5. The Standard Rules and the World Programme of Action and other instruments
of relevance should be used as reference tools in seeking implementation
measures.
Ensuring Sensitivity to Diverse Groups and Socio?Economic Conditions
6. The situation of all disability groups and the diverse conditions related
to gender, race, colour, age, ethnic and other considerations must be taken
into account when elaborating the convention.
7. When elaborating the convention, special attention should be paid to
the conditions of persons with disabilities in developing countries and
countries in transition.
Active Participation of Persons with Disabilities as a Essential Precondition
8. The drafting process must be based upon the fullest possible participation
of people with disabilities through their representative organizations
including of parents of people with severe intellectual disabilities unable
to represent themselves.
States should engage in broad consultations with organizations of disabled
people and should include representatives of organizations of people with
disabilities in their own delegations to the treaty drafting meetings of
the UN.
The UN should ensure the wide participation of representative national,
regional and international organizations of people with disabilities in
the process of drafting the convention like those united under the International
Disability Alliance.
Active efforts must be made to ensure the participation of organizations
of people with disabilities coming from developing countries and of women
with disabilities.
Providing a Strong Mechanism of Enforcement
9. The relevant treaty monitoring bodies, both at international and national
level, should be established and strengthened, with the purpose to monitor
and report on the implementation of the treaty, including dealing with
individual and group complaints .
10. A mechanism for the participation of organization of persons with disabilities
in the monitoring and implementation of the treaty should be provided.
