2007年11月27日から29日の間、スペインのマドリードにおいて、国連経済社会局(DESA)の呼びかけで開催された専門家会議「機能する条約を目指して:障害者の権利条約の実施における市民社会の参加」の参加者一同は、国連の各加盟国に対して次のとおり提案する:

先ず今回の会議の主催団体である国連、スペイン政府、ONCE財団に対して、今後のCRPD (障害者の権利条約)の実施において、障害者及びその代表組織(DPO)及び障害者団体のリーダーシップを受け入れて活動するNGO(関係団体*)がいかに参加していくかについて実り多い会議の開催を感謝する。

専門家グループ会議の参加者は、

障害者の権利条約(CRPD)が、障害者の基本的自由及び人権の完全な享有を可能にするために根幹的な貢献をすることを確信し、

この条約が明確に記すとおり、人権に基づく障害モデルへのパラダイムシフトが実現し、法律、政策、計画などが根底から改定されることを確信し、

CRPD は、人権と開発が同じひとつの流れであること、また包括的な開発がなければ人権は効果的に達成できず、障害者の人権を完全に尊重しなければ開発は達成できないことを明確にし、人権に基づく開発の明確な枠組みであることを確信し、

条約の実施プロセスのあらゆる段階及びレベルにおいて、障害者の代表組織(DPO)を通じて障害者のかかわりを得ることの基本的な重要性を確信し、

すべての国連加盟国に対して、CRPDの批准プロセスをスピーディに行い、この条約の早期発効を保証するように促し、

次のことを勧告する:
  1. 障害者の権利条約が発効した際には:

    1. この権利条約の締約国は、条約の内容と精神、特に第34条、段落3及び4に則って、専門家委員会の候補者を選択する際に、次の基準を採用すべきである:
      • 独立性
      • 様々な障害のある専門家の参加
      • 人権及び障害に関する専門性
      • 様々な障害者コミュニティーからの信頼
      • 地域的、文化的にバランスの取れた代表
      • ジェンダーバランス
       又、候補者の選択には次の手続きに関する基準を採用すべきである:
      • 選択するプロセスに国の代表的なDPOの参加
      • 透明性の確保、特に専門家委員会の候補者の履歴書を国連のウェブサイト上で、公表することを含む

    2. 条約の第40条第1段落に基づいて召集される締約国の会議は:
      1. CRPDの実施に関する具体的な案件を検討する。これは、第32条に記される、CRPDの目的と目標達成のための国の努力を支援する国際協力の義務達成を含む。
      2. 締約国であるか否かにかかわらず、すべての国連加盟国が参加できる。
      3. アドホック委員会の時と同じレベルで、障害者の代表組織(DPO)及び関連組織(NGO)の積極的な関わりを容易にする。これには次を含む:
        1. 議題の決定、準備、計画に参加。
        2. 専門家としての参加。その際必要に応じて資金援助を提供する。
      4. 条約の実施に関する知識や経験の共有を図り、戦略や行動から学んだことなどの報告を協力的な精神で行う場とする。
      5. 必要に応じて、会議中に始められた活動を継続し、フォローアップし、次回の会議を計画するなど、会議と会議の間の期間の作業も行う。

    3. 専門家委員会の設立後、障害者の代表組織および関係の代表者の積極的な関わりを容易にするためにOHCHR(人権高等弁務官事務所)が専門家委員会を支援する。これは、条約の第36条、段落5及び第38条、段落(a)に記される支援を含む。

    4. 国連加盟国は、DESA(経済社会局)及びOHCHR(高等人権弁務官事務所)内のCRPDのための事務局を強化し、それらの予算や資金を増やし、障害者の人権を促進することに特化する国連機関の設立の可能性を模索する。

    5. 加盟国は、障害者組織(DPO)が条約の実施に参加するために、障害者組織と協議しながら、能力開発のための国連プログラムを計画、開発する。

    6. 加盟国は、障害者組織(DPO)の代表と協力し、締約国会議および専門家委員会の準備と会議間作業への障害者組織(DPO)の参加を容易にするための連携制度(リエゾン・メカニズム)を計画し、設置する。

    7. 加盟国は、中・低所得国、および障害のある先住民の代表からなる障害者組織(DPO)の代表が締約国会議および専門家委員会へ参加できるようにするための資金調達の可能性の検討を含め、国連任意基金の役割範囲を見直す。

    8. 国連事務局は、すべてのCRPD関連の国連会議を開催する際に、情報・コミュニケーション、建物・敷地を含む、あらゆる面において、完全なアクセシビリティーを保障する。

    9. 国連事務局は、障害者組織(DPO)と協力して、CRPD(障害者の権利条約)の実施に関する包括的なハンドブックを作成する。

    10. 加盟国は、CRPD第4条3が義務付けている通り、当然のこととして障害者組織(DPO)の関わりを保障すべきであり、条約の実施に取り組むことに主眼を置く自主独立かつ完全に包括的な国内障害団体連合(障害者のリーダーシップを受け入れる関係団体の参加も可能)の設立または強化を支援する。

    11. 加盟国はCRPDの第8条に則って、障害者の権利と尊厳を促進するCRPDを広範囲に知らしめるための啓発活動にただちにとりかかる。

    12. 加盟国は、障害者組織(DPO)との協力のもと、CRPDを自国の言語に翻訳するよう努める。

  2. さらに、CRPDの完全実施を保障するため、次のとおり勧告する:

    1. 加盟国は、CRPD の実施のために十分な国家予算を確保し、政策や法律を公布する。また、このような取り組みは、障害者組織(DPO)の代表と密接に連携して行う。

    2. 他の国連人権条約委員会、人権委員会、その他すべての人権関連機構は、CRPD に則って、障害者組織(DPO)と協力し、障害者の人権を考慮する。

    3. 加盟国は、障害者に関係する問題を検討する際に、新しく作られたユニバーサル定期レビュー・プロセスを採用する。また、このプロセスの報告書作成のための国内会議には障害者組織(DPO)が参加できるようにする。

    4. 国内人権団体・組織は、国の代表的な障害者組織(DPO)と協議し、その取り組みに障害者の権利を含める。

    5. 国際開発協力の供与国あるいは受給国である加盟国は:
      1. CRPD の原則に則って、障害者組織(DPO)と連携しつつ、適切な団体と実施、フォローアップ、モニタリングのために協力して国際開発協力に障害も含める。
      2. 障害に特化した計画やプログラム、特に障害者およびその団体の能力開発に向けたものを含める。
      3. 開発援助に関する能力開発研修を提供し、障害者組織(DPO)の意義ある参加を可能にする。

    6. ブレトンウッズ機関【訳注:世銀、国際通貨基金(IMF)体制】を含む国連機関は:
      1. CRPD に照らして、その政策や計画を見直す。
      2. 障害を専門とする部局を設置し、すべての政策・計画に障害者の人権の保護と促進を考慮することで、CRPD の実施に貢献する。
      3. 障害に関係するすべての活動、組織間会議などにおいて、障害者組織と相談・協力する。

    7. 社会開発委員会はすべての事業において、特にコペンハーゲン・サミットのフォローアップに関する事業において、障害問題を扱う際にはCRPD に則って行う。

"Making it work - Civil society participation in the implementation of the Convention on the Rights of Persons with Disabilities"

DECLARATION OF MADRID

Expert Group

Madrid, November, 27 2007



We, the participants of the Expert Group Meeting Making it work - Civil society participation in the implementation of the Convention on the Rights of Persons with Disabilities, convened by the United Nations Department of Economic and Social Affairs, held in Madrid, Spain, from 27 to 29 November 2007 make the following recommendations to Member States of the United Nations:

Would like to start thanking the host organizations, the United Nations, the Government of Spain and Fundaci?n ONCE, for convening this meeting, which has allowed a fruitful discussion on the way forward in terms of the participation of persons with disabilities and their representative organizations (DPOs) as well as NGOs which accept DPO leadership (Allied NGOs ) in the implementation process of the CRPD.

We, the participants of the Expert Group Meeting,

Convinced of the fundamental contribution the Convention on the Rights of Persons with Disabilities (CRPD) will make for the full enjoyment of fundamental freedoms and human rights by persons with disabilities;

Convinced of the paradigm shift to a human rights based model of disability, which this Convention clearly embodies and which will mean fundamental changes in legislation, policies and programmes;

Convinced that the CRPD demonstrates that human rights and development are a single stream, that human rights cannot be effective without inclusive development and development could not be achieved without the full respect of human rights for persons with disabilities, the Convention being a clear framework for the rights based approach to development.

Convinced of the fundamental relevance of involving persons with disabilities through their representative organizations (DPOs) in all stages and levels of the implementation process of the Convention;

Urge all UN Member States to accelerate the ratification process of the Convention in order to ensure a swift entry in force of the CRPD,

And recommend that,

  1. When the Convention on the Rights of Persons with Disabilities enters into force:

    1. States Parties to the Convention on the Rights of Persons with Disabilities, consistent with the letter and spirit of the Convention and particularly Article 34, paragraphs 3 and 4 adopt the following criteria in the selection of candidates for the Committee of Experts:
      • Independence
      • Participation of experts with diverse disabilities
      • Expertise in human rights and disability
      • Credibility within the diverse disability community
      • Equitable regional and cultural representation
      • Gender balance
      And adopt the following procedural standards in the selection of candidates:
      • Involvement of representative national DPOs in the selection process
      • Transparency, including publicising the CVs of the candidates for the Committee of Experts on the UN website;

    2. The Conference of States Parties, mandated by article 40 paragraph 1:

      1. Considers substantive matters related to the implementation of the CRPD, including activities that will help to fulfil the obligation under article 32 to undertake measures of international cooperation in support of national efforts for the realisation of the purpose and objectives of the CRPD;
      2. Is open to all UN Member States, whether States Parties or not;
      3. Facilitates the active involvement of representative DPOs and allied NGOs, similar to the level of involvement achieved in the Ad Hoc Committee including:
        1. Contribute to setting the agenda, preparation and planning;
        2. Participation as experts, including through the provision of financial support, where necessary;
      4. Serves as a forum for knowledge sharing, exchange of experiences and lessons learned on strategies and practices to implement the Convention in a spirit of cooperation;
      5. Undertakes intersessional work, where appropriate, to continue and follow up on activities begun in the Conference and plan the following one;

    3. OHCHR assists the Committee of Experts, when it is established, to facilitate the active engagement of representative DPOs and allied NGOs with the Committee of Experts, including in those ways indicated in Article 36, paragraph 5 and Article 38, paragraph (a) of the Convention;

    4. UN Member States strengthen the Secretariat for the CRPD within DESA and OHCHR increasing their resources, and explore the feasibility of establishing a specific UN agency to promote the rights of persons with disabilities;

    5. Member States establish a UN initiative for capacity building of DPOs, designed and developed in consultation with such DPOs, to participate in implementation of the Convention;

    6. Member States support the establishment of a liaison mechanism, designed and implemented in co-operation with the representative DPOs, to facilitate the participation of DPOs in the preparatory and intersessional work for the Conference of States Parties and the Committee of Experts;

    7. Member States review the mandate of the Voluntary Fund, in view of including the possibility of financing the participation of DPOs from low and middle income countries and those representing indigenous persons with disabilities in the Conference of States Parties and in the Committee of Experts;

    8. The UN Secretariat ensures full accessibility, including information, communication and premises, for all CRPD related UN meetings;

    9. The UN Secretariat, in cooperation with DPOs, develops a comprehensive handbook on implementation of the CRPD;

    10. Member States support the establishment or strengthening of independent, fully inclusive national DPO coalitions, open to NGOs which accept DPO leadership, focusing on the implementation of the CRPD as an intrinsic element of the involvement of DPOs as mandated in Article 4.3 of the CRPD;

    11. Member States in accordance with article 8 of the CRPD immediately undertake wide awareness raising campaigns on the CRPD promoting the rights and dignity of persons with disabilities;

    12. Member States undertake translation of the CRPD into national languages in co-operation with DPOs;


  2. Furthermore, in order to ensure the full implementation of the CRPD, we recommend that:

    1. Member States allocate sufficient national resources and promulgate policies and legislation for the implementation of the CRPD and to do this in close involvement with representative DPOs;

    2. Other UN human rights treaty committees, the Human Rights Council and all human rights mechanisms consider the human rights of persons with disabilities as articulated in the CRPD, in co-operation with DPOs;

    3. Member States shall use the newly initiated Universal Periodic Review process to include the relevant issues pertaining to the rights of persons with disabilities and include DPOs in the national consultation process when preparing their submissions to this process;

    4. National human rights institutions include the rights of persons with disabilities in their work and to do it in consultation with national representative DPOs;

    5. Member States, which are either donor or beneficiaries of international development co-operation,

      1. Mainstream disability in international development cooperation following the principles of the CRPD with adequate bodies for implementation, follow-up and monitoring, working in collaboration with DPOs;
      2. Include disability specific initiatives and programs, particularly those directed to provide capacity building to persons with disabilities and their organisations; and
      3. Provide specific capacity building on development cooperation issues to ensure meaningful involvement of DPOs in these processes;

    6. UN agencies, including the Breton Woods institutions:

      1. Review their policies and programmes in light of the CRPD;
      2. Contribute to the implementation of the CRPD through establishing a specific disability department, as well as taking into account the protection and promotion of the human rights of persons with disabilities in all policies and programmes; and
      3. Consult and co-operate with DPOs in all activities related to disability, including the interagency meetings;

    7. The Commission on Social Development address disability issues consistent with the CRPD in all of its work, particularly related to the follow-up to the Copenhagen Summit.
